Appellant, Abdul Ghani, M.D., appeals a final order rendered by the Board of Medicine, placing Dr. Ghani on supervised probation and imposing a fine. Dr. Ghani contends the Board erred in finding that he deviated from the standard of care by failing to order an ambulance for his patient, when appellee, the Agency for Health Care Administration (AHCA), now the Department of Health, neither charged nor proved such violation in the administrative complaint; and in finding that he deviated from the standard of care by failing to perform a Thallium stress test within six weeks of the patients discharge from the hospital. We reverse, because AHCA did not charge Dr. Ghani with failure to order an ambulance, and there was no competent, substantial evidence showing that his failure to perform the Thallium stress test fell below the requisite standard of care.
